A Clear and Professional Instruction Process

MedicReport welcomes enquiries from solicitors acting for claimants or defendants, insurers and other organisations requiring independent healthcare expert opinion.

The instruction process

Six stages, from first enquiry to report

1

Initial Enquiry

A brief overview of the clinical matter and the opinion required.

2

Conflict of Interest Check

Consideration of potential conflicts before accepting confidential material.

3

Documentation Requirements

Identification of the clinical records and supporting evidence required.

4

Fee Estimate

Provision of an estimate based on the scope and complexity of the work.

5

Acceptance of Instructions

Agreement of the scope, fees, timescale and terms of engagement.

6

Report Preparation

Independent evaluation of the evidence and preparation of a reasoned professional opinion.

Professional responsibilities

Duty to the court

Where applicable, reports are prepared with regard to CPR Part 35, Practice Direction 35 and the relevant requirements governing expert evidence.

The expert’s overriding duty is to the court. Opinions are not influenced by whether the instruction originates from a claimant or defendant.

Helpful to include in an enquiry
  • The parties’ names, for the conflict check
  • The type of case and the issues in dispute
  • The type of opinion sought
  • Any deadline, hearing or limitation date
